Example 1A Hypos Affirmative Action (race-weighted college admission) cases: - Bakke v. California - Grutter v. Bollinger AssignmentsNOV. 10, 2017
ARTICLE 1 (Segregated proms) 1. Should government step in where private citizens create segregated environments? Go beyond prom. What about private businesses? 2. Is separating people on the basis of race automatically harmful? Why? Why not? Put another way, if both sets of students have a prom, why is that unequal (hint: it is....but why?). ARTICLE 2 (White House ban on transgender military service) 1. To what extent should the executive branch (which includes the military) be able to choose its stated priorities over equality? 2. Should governmental entities be able to discriminate on some bases, but not others? Consider gender identity, gender, talent, work ethic, belief systems, political beliefs, religion, etc.? ARTICLE 3 (Affirmative action) 1. Affirmative action policies at universities are meant to repair racial discrimination that occurred in the past and still occurs today. It does so by favoring a diverse student body, which often means students of color are admitted over white students with similar or better qualifications. Plainly: do you agree with such a policy, or the goal of achieving a diverse college campus? 2. If you agree, are the white students being treated "equally"? If you disagree, and favor pure equality of opportunity, might bias against people of color prevent that? 3. Can you think of other ways to achieve equality of opportunity in college admissions?
